These terms are the agreement between you and Build Safe Pro. By creating an account or using the service you accept them. If you are accepting on behalf of a company, you are confirming you have the authority to bind it.
"Build Safe Pro", "we" and "us" mean the business operating Build Safe Pro. "You" means the organization that holds the account. Everyone you add to your account is covered by these terms, and you are responsible for what they do with it.
Build Safe Pro is a web application for construction job sites. It records daily logs and safety observations, gives each job site its own page that opens in a phone browser, and produces printable worker badges from information workers enter themselves after scanning a QR code.
It runs in a browser. There is no mobile app to install, and the people submitting logs or making badges do not create accounts.
Signing in uses a one-time code sent to your email address rather than a password, so whoever controls that inbox controls the account. Keep it secure, and remove people from your account when they leave.
You are responsible for everyone you give access to. Adding someone by email address creates an account for them straight away, with no invitation to accept first, so only add addresses you are entitled to.
You must be at least 18 to hold an account.
New accounts get 30 days free. We do not ask for a card to start.
When the trial ends without a payment method on file, your subscription pauses and we may restrict access to the account until a card is added. We do not charge you and we do not delete anything. Adding a card in the billing portal resumes it.
Pricing is per job site, not per person. Every plan includes unlimited workers and unlimited office users; the plans differ only in how many job sites you can run at once. Current prices are on the pricing section of our home page.
Subscriptions are monthly, billed in advance in US dollars. Payments are processed by Stripe. We never see or store your card number.
If you reach your plan's job site limit you cannot create a new job site until you upgrade or delete one. A job site occupies a slot until it is deleted, so delete finished sites if you want the slot back, remembering that deleting a job site deletes its logs, workers and badges with it.
If a payment fails, or a subscription is paused or cancelled, we may restrict access to the account until it is brought current. Restricting access is not deletion: your records stay where they are and paying restores them. See the clause on suspension and termination below.
Each job site has a public page, plus public forms for submitting a log and for making a badge, reached by a long random token in the web address rather than a sign-in. You control where posters are hung and who gets links.
You decide what to collect and from whom. We store and process worker records on your instruction. In the language of privacy law, you are the controller of that information and we are your processor.
That makes some things your responsibility, not ours:
Our privacy policy describes exactly what the service collects, where it is stored, who else touches it, and how someone asks for their information to be deleted.
Phone numbers reach the service because the person they belong to typed them in. A worker scans the poster themselves, chooses whether to make a badge, chooses whether to give a number at all, and agrees on the form to be texted before it will submit. A log submission works the same way. The consent is express, it is given by the individual, and it is given at the moment the number is entered. Nobody is enrolled by a supervisor, and there is no way to upload a list of numbers.
The service does not require a worker to make a badge, and the phone number is optional when they do.
Staff can edit a worker's record from the roster, so this part is yours: do not enter a phone number on someone else's behalf, and do not ask a worker to enter a number that is not theirs. A number added that way has consented to nothing.
Your logs, photographs, worker records and everything else you or your workers put into the service belong to you. We claim no ownership of them.
You give us the permission we need to actually run the service on your behalf: to store your content, transmit it, display it back to the people you have given access, compose worker photographs into badge images, and send Spanish-language text to a machine translation provider so your office can read it in English. That permission exists for those purposes and stops there. We do not use your content to advertise, and we do not sell it.

The software, the brand, the badge and poster designs and everything else we made stay ours. These terms give you the right to use the service, not to own any part of it. If you send us ideas or feedback we can use them freely, with no obligation to you.
The service depends on other companies for hosting, storage, payments, email, text messages, mapping and translation. They are listed in the privacy policy. We choose them carefully, but we do not control them, and an outage or failure at one of them is not a breach of these terms by us.
This clause matters more than the others, so read it.
Build Safe Pro is a record-keeping and communication tool. It stores what people type and photograph and puts it in front of the right person. That is all it does.
It does not inspect your job sites. It does not check whether what someone submitted is true, complete or timely. It does not decide whether a site is safe, whether a hazard was actually corrected, or whether a worker is qualified or authorized to be there. A worker badge produced by the service is an identification card printed from what that worker typed about themselves; it is not a credential, a certification, or evidence that anyone has been trained or vetted.
The service is not a safety program, a substitute for a competent person's judgment, or a compliance product. Using it does not make you compliant with OSHA or any other regulator, and we make no representation that it does. Responsibility for safety on your job sites, and for meeting the rules that apply to your work, remains entirely yours.
We work to keep the service running and we would rather it never broke. But we do not offer a guaranteed uptime commitment, and the service is provided as is and as available.
To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error free, or that it will preserve any particular piece of data forever.
To the fullest extent the law allows, neither party is liable to the other for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost revenue or lost data, even if warned they were possible.
Our total liability for any and all claims arising out of the service is limited to the amount you paid us in the twelve months before the event giving rise to the claim.
These limits apply regardless of the legal theory, and they survive termination. Some jurisdictions do not allow some of these exclusions; where that is true, they apply to the extent permitted.
You will defend and indemnify us against claims, damages and reasonable legal costs arising from your content, your use of the service, your breach of these terms, or a claim by someone whose personal information you collected through the service.
You can stop using the service and cancel at any time. We may suspend or close an account for non-payment, for a breach of these terms, or where we are required to.
Export anything you want to keep before you cancel. Being clear about what happens afterwards: we do not automatically delete your account's records when a subscription lapses or is cancelled, because a safety record is often the thing you need years later. If you want your data deleted, email info@buildsafepro.com and we will do it within 30 days. Deleting a job site in the app deletes its logs, workers and badges immediately. Our encrypted database backups roll off after one month, so deleted content can persist in a backup for up to that long.
We may update these terms. When we make a change that matters, we will email the account's admins or post the revised date at the top of this page before it takes effect. Continuing to use the service after that means you accept the new version.
These terms are governed by the laws of the State of Montana, without regard to its conflict of laws rules. Any dispute arising out of them or out of the service will be brought exclusively in the state or federal courts located in Montana, and both parties consent to those courts.
If any part of these terms is found unenforceable, the rest stays in force. Our not enforcing something is not a waiver of it. You may not assign these terms without our consent; we may assign them to a successor of the business.
